Services & Enrollment

• Service description. We provide instructor‑led swim lessons for children and adults focused on safety, technique, and confidence. Lessons are personalized to ability and age.

• Enrollment requirements. Enrollment requires a completed registration form, accurate medical disclosures, and payment as described below. Parents/guardians must remain on‑site unless a written exception is agreed.

Payment, Refunds, Attendance & Cancellations

• Payment terms. Payment is due before the first scheduled lesson. We accept cash, credit/debit, and Zelle. Packages must be used within the session period unless otherwise arranged.

• What to Bring to the lesson? swimsuit, towel, goggles, swim diaper (if applicable) and sunscreen (apply before lesson).

• Attendance. Lessons must be scheduled in advance. Late arrivals do not extend lesson time. Arrive 5 minutes early. Swimmers must be ready to enter the water at the start time.

• Cancellation & refunds. Parents must notify cancellations at least 24 hours in advance. Cancellations with less than 24-hour notice will result in a $35 fee; make-up lessons are offered based on schedule availability. Refunds are issued only where required by law or at our discretion.

Safety, Weather & Instructor Qualifications

• Assumption of risk. Swimming involves inherent risks including slips, drowning, sun exposure, and exertion; by participating you acknowledge these risks.

• Safety expectations. Swimmers must follow instructor directions; no running, no pushing or unsafe behavior on the deck. Do not attend if the student has diarrhea or a contagious condition within the last 48 hours.

• Parent Responsibilities (Additional Details). Parents must wait inside during the lesson. Parents are invited out only for the last 15 minutes. Encourage your child but allow the instructor to lead.

• Weather policy. Lessons continue in light rain; lessons are paused or rescheduled for thunder, lightning, or other dangerous conditions. We will notify families of weather delays.

• Instructor qualifications. Instructors are trained in swim instruction and basic first aid/CPR; certifications vary by instructor and are maintained as required.

Liability, Disclaimers & Indemnification

• No guarantee of outcomes. We do not guarantee specific skill levels or timelines; progress varies by student.

• Limitation of liability. To the fullest extent permitted by law, Swim Lessons with Kelly’s liability for claims arising from lessons is limited to the amount paid for the lesson(s).

• Indemnification. You agree to indemnify and hold us harmless from claims arising from your or your child’s negligence or failure to follow rules.

• By providing a mobile number you opt in to receive SMS messages about scheduling, lesson reminders, weather alerts, and occasional marketing. Message frequency varies. Email (CAN‑SPAM) Disclosures

• We collect email addresses via registration forms and sign‑ups. We may send transactional (scheduling, receipts) and marketing emails. You may unsubscribe using the link in any marketing email; we will honor opt‑outs promptly as required by CAN‑SPAM. Our business contact information is below.

Data, Privacy & Third Parties

• How we use data. We use personal information to manage enrollment, scheduling, payments, and communications.

• Storage. Data is stored securely and retained only as needed.

• We use third‑party providers for scheduling and payments; these providers have their own security practices.

• You have rights to access, correct, or request deletion of your data; contact us to exercise those rights.

Communications Compliance Notes

• We follow carrier and industry standards for SMS (including CTIA HELP/STOP expectations) and TCPA rules; opt‑in flows and disclosures are maintained for compliance.
